If you do not agree to these terms, you should refrain from accessing any content, information, products, or services available on Dranytime’s website. It is important to note that Dranytime is the exclusive owner, maintainer, and overseer of the website, and therefore retains the authority to enforce this Agreement at any time.

Dr.anytime is an online platform that provides Services through facilitating interactions between Mental Health Professionals and Employees. However, it is important to note that Oliva is not a healthcare provider or a medical service provider. While the Professionals you may access through the Platform are highly qualified, it is essential that you do not rely solely on the Platform for medical advice. It is imperative that you seek medical advice from a licensed healthcare provider if you have any medical concerns or suspect you have a medical condition. The Platform should not be used to replace or delay seeking medical attention from a qualified healthcare professional.

In the event of an emergency or medical crisis, it is crucial that you contact emergency services and inform the relevant authorities immediately. Please be advised that the information available on the Platform is not intended as medical advice, nor is it a substitute for consulting a qualified healthcare professional.

Dr.anytime makes every effort to ensure that the information provided on the Platform is accurate and up-to-date, but cannot be held liable for any actions or decisions taken by Employees based on the information provided. Ultimately, it is the responsibility of the Employees to determine how to use the information provided on the Platform, and any reliance on such information is done at their own risk.

We may contact you through various means such as  the Platform, phone calls, text messages, or by sending an email to the address associated with your account. It is important to note that when we use the terms writing or written in these terms, it also encompasses communication via email.

6.Collaborating with an expert or specialist using the online platform.

Our online platform provides access to mental health experts or specialists for the purpose of consultations, treatment, and therapy.We carefully select our mental health experts or specialists to ensure they have the appropriate qualifications and experience.We welcome feedback and suggestions from our users and use it to continually improve our online platform and the services we provide.

Duration of the session or meeting with a professional.

Our Mental Health Professionals are typically able to dedicate up to 60 minutes per session for each consultation. However, the actual duration of your session may vary depending on the availability and schedule of your chosen professional. If there are any unexpected circumstances or emergencies that require rescheduling your session, we will promptly inform you and make the necessary arrangements.

The official standing or legal position of the professionals.

The Mental Health Professionals available on Dr.anytime may serve as either independent contractors, consultants, or staff members of the platform. They are responsible for providing their services to you and must fulfil their legal duty of care obligations as per their regulatory guidelines. Each Mental Health Professional is responsible for obtaining your informed consent for any assistance or guidance they offer, which includes your permission to use online health services during any consultations conducted through the Platform. This consent will be obtained verbally and aligned with the professional standards mandated by the Mental Health Professional.

The Mental Health Professional will base their assessment and recommendations on the information that you provide to them.

In order to offer the appropriate standards of care, the Mental Health Professional will rely on the information you provide, including the results of any assessments conducted on the Platform. Therefore, it is crucial that you provide all relevant information to your Mental Health Professional, as this will inform the support they provide to you. This will help them make an accurate assessment and provide you with suitable recommendations, tailored to your specific needs.

It may be necessary for us to get in touch with you to cancel or rearrange any scheduled sessions.

In some instances, a Mental Health Professional may have to cancel a session that has been confirmed. In such cases, we will promptly inform you of the cancellation, and you will have the option to schedule a new session via the Platform.

Availability of the Mental Health Professional.

In the event that the Mental Health Professional who was initially providing you with support is no longer available on the Platform, we will strive to connect you with another Mental Health Professional who can offer you the necessary support.

 

We may use observation and video recordings of your consultations with a Mental Health Professional for quality assurance and accreditation purposes.

By default, Dr.anytime does not observe or record sessionsHowever, to maintain the quality of service provided by our Mental Health Professionals and to support their re-accreditation with their professional body membership, we may seek your permission to record a session or allow a senior clinical team member to observe a session in real-time. No recording will be made without your explicit consent. If you do consent to a session being recorded, it will be kept securely, used only for its intended purpose, and permanently deleted within 45 days. All video sessions are end-to-end encrypted to ensure the confidentiality and privacy of your information.

What are the fees or charges associated with the service?

At Dr.anytime, members are charged for each therapy session based on the duration of their session with the therapist. The session fee may differ depending on the therapist’s fee and whether the session is online or in-person. However, you will always be informed of the session fee beforehand, enabling you to make an informed decision when selecting a therapist to work with.

Term and Termination

You will become bound by this Agreement upon your acceptance of its terms, as outlined above. This Agreement will continue to be in effect for as long as you utilise  services provided by us, or until we terminate the Agreement, whichever occurs first. The terms and conditions outlined in this Agreement will apply throughout the entire duration of our relationship.In this situation your Employer will be responsible for informing you of the termination of the Services.

 Ending of Employment Contract

If your employer is the one providing access to the Services, then your access to the Platform and its various offerings will be dependent on your association with their account. In the event that you are no longer connected to your employer’s account, your access to the Platform and its Services will be terminated.

Information you provide to us is accurate and complete

This includes personal or sensitive data that you may provide through various means such as creating an account, filling out forms, or communicating with us directly. It is important to note that certain features of the Platform or Services may require specific information to be provided, and failure to provide such information accurately and completely may impact your ability to fully utilise those features. We will handle your information in accordance with our privacy policy and applicable laws and regulations.

By registering on the Platform, you will be provided with an Account to enter, store and access your information online. This Account will also facilitate communication between you and your Professional regarding the Support provided to you. The information you store on your Account will be subject to these Terms, as well as our Privacy Notice & Cookie Policy. It is important that you provide accurate and complete information when creating your Account and periodically review and update it as needed. We are committed to maintaining the confidentiality and security of your Account information in accordance with our policies and applicable regulations.

All messages that you send and receive through the Platform will be recorded and stored as a part of your Account.

Your Account will include all messages that you send and receive through the Platform. It is important to note that our messaging system is end-to-end encrypted, meaning that only you and the Professional providing Support to you can access the content of these messages. However, in situations where there is a legal obligation to do so, someone other than your Professional may need to access these messages. We take the confidentiality and security of your Account information seriously and will only disclose your messages in accordance with our policies and applicable laws and regulations. Please refer to the details provided below for more information.

Prior to utilising the Platform’s services, it is necessary to obtain consent for therapy and for disclosing any relevant information.

By using the Platform, you agree to your designated Professional using your health and wellbeing information to provide Support and confirm sessions. We may disclose the contents of your Account, including session outcomes and assessments, to your Professional(s) to ensure appropriate Support. Your Professional will not routinely communicate with your GP or healthcare provider, but may do so with your consent in case of serious concerns about your wellbeing. If you withdraw your consent, we may still need to use your information if we have serious concerns about your wellbeing. Please refer to our Privacy Notice and Cookie Policy for more information on how we use your personal data in connection with Dr.anytime.

Limitation of Liability

We acknowledge our legal responsibilities for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, which cannot be excluded by law. However, we shall not be legally liable for any direct or indirect loss or damage resulting from the use of the Platform, except for our legal obligations.

We have excluded all other legal obligations that may be implied or incorporated into the Terms by law or regulation to the extent permitted by law. These Terms are intended to be comprehensive and clear, and we do not intend to imply any other terms.

If any limitation or exclusion of liability in the Terms is not enforceable, our liability to you or your employer shall not exceed 100% of the fees paid for the Services provided to you in the twelve months preceding your complaint.

Your compliance with these Terms

If you violate these Terms or we reasonably suspect that you have breached them, we may take actions including (a) issuing one or more formal warnings, (b) temporarily suspending your access to our Platform, (c) permanently blocking your access to our Platform, (d) blocking computers using your IP address from accessing our Platform, (e) contacting your internet service providers to request that they block your access to our Platform, and/or (f) commencing legal action against you.

The Content on this Platform, which includes information, design, layout, appearance, and graphics, belongs to us or is licensed to us.

Your use of the Platform gives you a limited licence to access the Content, but you do not own any of it and will never have ownership of it.

We hold the legally enforceable rights over the Content, including copyright, and we consider these rights to be important and will retain them at all times.

If we have placed legal notices, such as copyright notices, on the Content, you must not erase or eliminate them.

Confidentiality

The privacy of your therapy sessions is of utmost importance to us, and we maintain strict confidentiality throughout the process. However, there are certain circumstances under which your therapist may be legally or ethically required to disclose information to a third party, such as if there is a risk of harm to yourself or others.

If you were referred to us by another healthcare professional, we will inform them that you are receiving therapy from us, but we will not disclose any further details without your express consent.

All information entered onto our platform is stored securely in order to ensure your safety and wellbeing, even if you choose to delete it later. Only senior members of our clinical and safeguarding team will be able to access your clinical notes, and this will only be done when necessary to ensure your safety and continued care.

In order to provide the highest quality care and maintain our commitment to connected care with our partners, we take concerns and complaints very seriously. Any such issues will be thoroughly investigated and reported back to our partners in a timely and responsible manner.

Understanding Membership: Benefits and Requirements

To access therapy with one of our therapists, members must first register at Dr.anytime. We take the safety and effectiveness of your therapy seriously, which is why we are required to collect certain personal information from you before starting your therapy. You will not be able to begin therapy until we have received these details.

Failure to adhere to these terms may result in the suspension of your access to Dr.anytime. and future therapy sessions. If you are experiencing difficulties in paying your Payment, please inform us as soon as possible so that we can work with you to find a suitable solution.

Dr.anytime reserves the right to remove or deny entry to its platform to any individual. If this action is taken, the member’s account will be deleted.

At Dr.anytime, we have a strict policy against any form of offensive or discriminatory behaviour. If our staff or therapists experience such behaviour from any individual, we may be unable to provide our services to that person.

We understand that some individuals may have preferences regarding their therapist. In such cases, one of our senior clinicians may contact you to discuss your preferences and reasons for them. While we will try our best to accommodate your preferences if it is appropriate and possible to do so, our priority is to match clinical needs with therapist expertise. In the event that we are unable to support you, we will provide referrals to other services.

Other Issues

Occasionally, we may need to temporarily suspend our services to deal with technical issues or make minor adjustments. While we aim to keep these suspensions brief, we will not be responsible for any loss or damages you may incur as a result of such interruptions, regardless of their duration.

Our therapists may experience unforeseen delays or have to miss sessions due to circumstances beyond their control. If this occurs, we will promptly notify you and take appropriate measures to minimise the impact of the delay. However, we cannot be held liable for any delays caused by such events. If a substantial delay is anticipated, you may be entitled to a refund for any services you have paid for but have not received.

Please note that we cannot issue any refunds if you are unable to access our platform due to technical issues with your equipment or internet connection.

Amendment and Assignment

We have the right to modify or amend this Agreement without any prior notice to you. However, we will make the revised version available on the Website so that you can access the latest version. You understand and accept that it is your responsibility to check the Website regularly for any updates or changes.

You are not allowed to transfer this Agreement or the rights and responsibilities outlined in this Agreement to any third party. You are solely responsible for complying with the terms and conditions of this Agreement and any breaches that occur.
